1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and HairSimulate.com ("HairSimulate," "we," "us," or "our") governing your access to and use of the HairSimulate.com website, mobile application, and related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the Service. If you are using the Service on behalf of a company, organization, or other entity, you represent and warrant that you have authority to bind such entity to these Terms.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using the Service, you represent and warrant that:

  • You are at least 18 years old
  • You have the legal capacity to enter into these Terms
  • You will comply with all applicable laws and regulations
  • All information you provide is accurate and current

3. Service Description

HairSimulate provides an AI-powered hair transplant simulation service that allows users to upload photos and generate simulated "before and after" images showing potential hair restoration results.

3.1 Free Trial

  • Registered Users: Receive 1 free credit upon registration
  • Phone-Verified Users: Receive 3 free credits upon phone verification
  • Credits are used to generate simulations (1 credit per simulation)
  • Credits do not roll over between billing periods

3.2 Anonymous Users

  • Limited to 1 simulation per session
  • Simulations are watermarked and lower quality
  • A 2-minute processing delay applies
  • No account required for basic use

3.3 Authenticated Users

  • Access to high-quality HD simulations (1024px resolution)
  • All results include a subtle trademark watermark for brand protection
  • No processing delays for phone-verified users
  • Ability to save and download simulations
  • Access to simulation history
  • 3 free credits upon phone verification

3.4 Medical Disclaimer

IMPORTANT

The Service provides AI-generated simulations for illustrative purposes only. These simulations:

  • Are NOT medical advice, diagnosis, or treatment recommendations
  • Do NOT guarantee actual hair transplant results
  • Should NOT be used to make medical decisions
  • Are NOT a substitute for professional medical consultation

You acknowledge that actual hair transplant results may vary significantly from AI-generated simulations. Always consult with a licensed medical professional before making any decisions regarding hair restoration procedures.

4. User Accounts

4.1 Account Creation

To access certain features, you must create an account by:

  • Providing accurate and complete information
  • Verifying your email address
  • Optionally verifying your phone number for additional credits

You may create an account using:

  • Email and password
  • Google OAuth
  • Facebook OAuth
  • Instagram OAuth

4.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Ensuring your account information remains accurate

4.3 Account Suspension or Termination

We reserve the right to suspend or terminate your account if you:

  • Violate these Terms
  • Engage in fraudulent, abusive, or illegal activity
  • Attempt to circumvent credit limits or system restrictions
  • Misuse the Service in any way

5. User Content and Licenses

5.1 User Content

"User Content" includes any photos, images, data, or information you upload, submit, or transmit through the Service.

5.2 Image Upload Requirements

When uploading photos for simulation, you must ensure:

  • Images are in PNG, JPG, or JPEG format
  • File size is reasonable (recommended: under 5MB)
  • Images clearly show your face and current hairline
  • You have the legal right to upload the images
  • You have obtained consent from any individuals appearing in the photos

5.3 Your Rights

You retain all ownership rights to your original User Content. However, by using the Service, you grant us a worldwide, non-exclusive, royalty-free license to:

  • Store, process, and display your User Content as necessary to provide the Service
  • Generate simulations based on your User Content using AI technology
  • Store both original and processed images securely for the retention periods specified in our Privacy Policy
  • Use anonymized, aggregated data for analytics and service improvement

Important: We do NOT use your identifiable images for training AI models without your explicit consent. If we wish to use your images for AI training purposes, we will request your separate, explicit permission.

5.4 Image Processing and Storage

Image Processing:

  • Your images are processed by third-party AI service providers to generate simulations
  • Both original (before) and processed (after) images are securely stored
  • Images are stored using industry-standard encrypted cloud storage
  • All stored images are encrypted in transit and at rest

Image Storage:

  • Images are stored securely using encrypted cloud storage
  • Original photos and simulation results are stored separately
  • Anonymous users: Images retained indefinitely for service improvement and analytics. You can request deletion at any time.
  • Authenticated users: Images retained for the duration of your account (or until you request deletion)

Third-Party Processing:

  • Images are processed by third-party AI service providers for simulation generation
  • Images are not shared with third parties for purposes other than necessary AI processing
  • All third-party processors are contractually obligated to protect your data and comply with applicable data protection laws

5.5 Optional Marketing Consent

Separate from the basic service license above, you may choose to grant us permission to use your anonymized simulation images (with faces blurred or obscured) for marketing and promotional materials. This consent is:

  • Completely optional and separate from using the Service
  • Requested separately and requires your explicit opt-in
  • Revocable at any time by contacting us
  • Limited to anonymized/obscured versions of your images
  • Not required to use the Service

If you grant marketing consent, anonymized images may be retained indefinitely until you revoke consent.

5.6 Your Responsibilities

You represent and warrant that:

  • You own or have the legal right to use all User Content you submit
  • Your User Content does not violate any third-party rights (including privacy, publicity, or intellectual property rights)
  • You have obtained all necessary consents (e.g., from individuals appearing in photos)
  • Your User Content complies with all applicable laws

5.7 Prohibited Content

You may not upload User Content that:

  • Contains nudity, explicit sexual content, or adult material
  • Depicts violence, hate speech, or illegal activity
  • Infringes on intellectual property rights
  • Violates privacy rights of others
  • Contains malware, viruses, or harmful code
  • Contains images of minors without parental consent

6. Acceptable Use

You agree NOT to:

  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated systems (bots, scrapers) to access the Service
  • Attempt to circumvent credit limits, delays, or quality restrictions
  • Misrepresent simulations as actual medical results or guarantees
  • Use the Service for any illegal purpose
  • Interfere with or disrupt the Service or servers
  • Impersonate any person or entity
  • Collect or harvest information about other users
  • Use the Service to transmit spam, chain letters, or unsolicited communications

7. Intellectual Property

The Service, including all software, algorithms, AI models, designs, text, graphics, and other content, is owned by HairSimulate or its licensors and is protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.

8. Payment and Billing

Credits System:

  • Simulations consume 1 credit each
  • Credits are non-refundable
  • Credits do not expire but may be subject to account limitations

We reserve the right to modify pricing with 30 days' notice. Continued use after price changes constitutes acceptance.

9. Service Availability and Modifications

We strive to maintain Service availability but do not guarantee uninterrupted or error-free operation. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that simulations will match actual hair transplant outcomes or that the Service will meet your specific requirements.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless HairSimulate, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses arising out of or relating to your use of the Service, your User Content, or your violation of these Terms.

13. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

14. Termination

You may stop using the Service at any time by deleting your account or contacting us. We may suspend or terminate your access immediately if you violate these Terms, engage in fraudulent activity, or misuse the Service.

Upon termination, your right to use the Service immediately ceases, and we may delete your account and User Content.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Turkey, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey.

16. General Provisions

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HairSimulate regarding the Service.

We reserve the right to modify these Terms at any time. Material changes will be notified via email, notice on the Service, and an updated "Last Updated" date. Continued use of the Service after changes constitutes acceptance of the modified Terms.
