1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and HairSimulate.com ("HairSimulate," "we," "us," or "our") governing your access to and use of the HairSimulate.com website, mobile application, and related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the Service. If you are using the Service on behalf of a company, organization, or other entity, you represent and warrant that you have authority to bind such entity to these Terms.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using the Service, you represent and warrant that:

  • You are at least 18 years old
  • You have the legal capacity to enter into these Terms
  • You will comply with all applicable laws and regulations
  • All information you provide is accurate and current

3. Service Description

HairSimulate provides AI-powered hair and eyebrow transplant simulation services that allow users to upload photos and generate simulated visualizations of potential restoration results. Verified members may also use optional Community features to share progress photos, stories, and linked simulations in a member feed.

3.1 Free Trial

  • Registered Users: Receive 1 free credit upon registration
  • Phone-Verified Users: Receive +1 bonus credit upon phone verification (2 total with signup credit)
  • Credits are used to generate simulations (1 credit per simulation)
  • Credits do not expire

3.2 Anonymous Users

  • Limited to 1 simulation per session
  • Simulations are watermarked and lower quality
  • A 60-second processing delay applies
  • No account required for basic use

3.3 Authenticated Users

  • Access to high-quality HD simulations (1024px resolution)
  • All results include a subtle trademark watermark for brand protection
  • No processing delays for phone-verified users
  • Ability to save and download simulations
  • Access to simulation history
  • Access to Community features for sharing progress photos and simulations
  • 2 free credits total (1 at signup + 1 phone verification bonus)

3.4 Eyebrow Transplant Simulation (Beta)

We offer an optional eyebrow transplant simulation mode (public beta) that generates a mature 12-month style preview from a single front-facing photo. This beta may change in quality, availability, or parameters without notice.

  • Each eyebrow simulation consumes 1 credit, the same as a hair simulation
  • Beta results are illustrative only and are subject to the same medical disclaimer in Section 3.5
  • You must upload a clear front-facing photo suitable for brow and facial analysis

3.5 Medical Disclaimer

IMPORTANT

The Service provides AI-generated simulations for illustrative purposes only. These simulations:

  • Are NOT medical advice, diagnosis, or treatment recommendations
  • Do NOT guarantee actual hair transplant results
  • Should NOT be used to make medical decisions
  • Are NOT a substitute for professional medical consultation

You acknowledge that actual hair transplant results may vary significantly from AI-generated simulations. Always consult with a licensed medical professional before making any decisions regarding hair restoration procedures.

4. User Accounts

4.1 Account Creation

To access certain features, you must create an account by:

  • Providing accurate and complete information
  • Verifying your email address
  • Optionally verifying your phone number for additional credits

You may create an account using:

  • Email and password
  • Google OAuth
  • Facebook OAuth
  • Instagram OAuth

4.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Ensuring your account information remains accurate

4.3 Account Suspension or Termination

We reserve the right to suspend or terminate your account if you:

  • Violate these Terms
  • Engage in fraudulent, abusive, or illegal activity
  • Attempt to circumvent credit limits or system restrictions
  • Misuse the Service in any way

5. User Content and Licenses

5.1 User Content

"User Content" includes any photos, images, progress photos, simulation results, Community posts, comments, tags, reports, profile interactions, data, or information you upload, submit, publish, or transmit through the Service.

5.2 Image and Community Upload Requirements

When uploading photos or posting Community content, you must ensure:

  • Simulation images are in PNG, JPG, or JPEG format
  • Community image uploads use supported formats such as JPEG, PNG, or WebP and comply with the posted upload limits
  • File size is reasonable and within product limits
  • Images clearly show your face and current hairline
  • You have the legal right to upload the images
  • You have obtained consent from any individuals appearing in the photos
  • You do not post medical claims, identifying information, or third-party personal data unless you have permission and the content complies with these Terms

5.3 Your Rights

You retain all ownership rights to your original User Content. However, by using the Service, you grant us a worldwide, non-exclusive, royalty-free license to:

  • Store, process, and display your User Content as necessary to provide the Service
  • Generate simulations based on your User Content using AI technology
  • Publish and display Community posts, comments, uploaded progress photos, tags, and attached simulation results according to your selected visibility setting
  • Moderate, remove, restrict, or preserve Community content where necessary for safety, compliance, support, or enforcement
  • Store both original and processed images securely for the retention periods specified in our Privacy Policy
  • Use anonymized, aggregated data for analytics and service improvement

Important: We do NOT use your identifiable images for training AI models without your explicit consent. If we wish to use your images for AI training purposes, we will request your separate, explicit permission.

5.4 Image Processing and Storage

Image Processing:

  • Your images are processed by third-party AI service providers to generate simulations
  • Both original (before) and processed (after) images are securely stored
  • Community progress photos are stored in our configured Community storage bucket
  • Simulation results attached to Community posts are linked only after ownership validation
  • Images are stored using industry-standard encrypted cloud storage
  • All stored images are encrypted in transit and at rest

Image Storage:

  • Images are stored securely using encrypted cloud storage
  • Original photos and simulation results are stored separately
  • Community posts and images are retained while the post or account remains active, subject to deletion requests, backups, moderation records, and legal obligations
  • Anonymous users: Images retained indefinitely for service improvement and analytics. You can request deletion at any time.
  • Authenticated users: Images retained for the duration of your account (or until you request deletion)
  • Community posts: Text, images, comments, likes, bookmarks, and follows are retained while the post or account remains active, subject to deletion, moderation, backups, and legal obligations

Third-Party Processing:

  • Images are processed by third-party AI service providers for simulation generation
  • Images are not shared with third parties for purposes other than necessary AI processing
  • All third-party processors are contractually obligated to protect your data and comply with applicable data protection laws

5.5 Optional Marketing Consent

Separate from the basic service license above, you may choose to grant us permission to use your anonymized simulation images (with faces blurred or obscured) for marketing and promotional materials. This consent is:

  • Completely optional and separate from using the Service
  • Requested separately and requires your explicit opt-in
  • Revocable at any time by contacting us
  • Limited to anonymized/obscured versions of your images

If you grant marketing consent, anonymized images may be retained indefinitely until you revoke consent.

5.6 Your Responsibilities

You represent and warrant that:

  • You own or have the legal right to use all User Content you submit
  • Your User Content does not violate any third-party rights (including privacy, publicity, or intellectual property rights)
  • You have obtained all necessary consents (e.g., from individuals appearing in photos)
  • Your User Content complies with all applicable laws

5.7 Prohibited Content

You may not upload User Content that:

  • Contains nudity, explicit sexual content, or adult material
  • Depicts violence, hate speech, or illegal activity
  • Infringes on intellectual property rights
  • Violates privacy rights of others
  • Contains malware, viruses, or harmful code
  • Contains images of minors without parental consent

5.8 Community Sharing

Community is an optional feature. If you publish a post, you are choosing to share the selected content under the visibility setting shown in the product:

  • Public: Visible to everyone, including logged-out visitors, and may be indexed, cached, screenshotted, or shared outside HairSimulate
  • Community: Visible to logged-in HairSimulate users
  • Anonymous: Hides your author identity from other users, but it is not anonymous to HairSimulate; we retain the account association needed for ownership, deletion, support, safety, moderation, and legal compliance
  • Your Responsibility: You are responsible for what you share, including progress photos, simulation results, comments, tags, clinic or procedure details, and any personal information you include
  • Moderation: We may review reports and remove, restrict, preserve, or disable Community content or accounts that violate these Terms or create safety, privacy, legal, or abuse concerns

Community content is not medical advice. Do not use Community to harass others, impersonate anyone, disclose private information, advertise spam, make deceptive clinic or procedure claims, or guarantee medical outcomes.

6. Acceptable Use

You agree NOT to:

  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated systems (bots, scrapers) to access the Service
  • Attempt to circumvent credit limits, delays, or quality restrictions
  • Misrepresent simulations as actual medical results or guarantees
  • Use the Service for any illegal purpose
  • Interfere with or disrupt the Service or servers
  • Impersonate any person or entity
  • Collect or harvest information about other users
  • Use the Service to transmit spam, chain letters, or unsolicited communications
  • Harass, abuse, or threaten other Community members or users
  • Post spam, advertising, or unsolicited promotions in Community
  • Disclose another person's private medical or personal information without their consent

7. Intellectual Property

The Service, including all software, algorithms, AI models, designs, text, graphics, and other content, is owned by HairSimulate or its licensors and is protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.

8. Payment and Billing

Credits System:

  • Simulations consume 1 credit each
  • Credits are generally non-refundable once spent on a completed simulation
  • Credits may be refunded if you delete a simulation that is still pending or processing, per product rules
  • Credits do not expire but may be subject to account limitations

We reserve the right to modify pricing with 30 days' notice. Continued use after price changes constitutes acceptance.

9. Service Availability and Modifications

We strive to maintain Service availability but do not guarantee uninterrupted or error-free operation. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that simulations will match actual hair transplant outcomes or that the Service will meet your specific requirements.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless HairSimulate, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses arising out of or relating to your use of the Service, your User Content, or your violation of these Terms.

13. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

14. Termination

You may stop using the Service at any time by deleting your account or contacting us. We may suspend or terminate your access immediately if you violate these Terms, engage in fraudulent activity, or misuse the Service.

Upon termination, your right to use the Service immediately ceases, and we may delete your account and User Content.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Turkey, without regard to its conflict of law provisions.

Before initiating formal legal proceedings, we ask that you first contact us at info@hairsimulate.com to attempt to resolve the dispute informally.

Any disputes that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey.

16. General Provisions

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HairSimulate regarding the Service.

We reserve the right to modify these Terms at any time. Material changes will be notified via email, notice on the Service, and an updated "Last Updated" date. Continued use of the Service after changes constitutes acceptance of the modified Terms.
