1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and HairSimulate.com ("HairSimulate," "we," "us," or "our") governing your access to and use of the HairSimulate.com website, web application (app.hairsimulate.com), and related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the Service. If you are using the Service on behalf of a clinic, company, organization, or other entity, you represent and warrant that you have authority to bind such entity to these Terms.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using the Service, you represent and warrant that:

  • You are at least 18 years old
  • You have the legal capacity to enter into these Terms
  • You will comply with all applicable laws and regulations
  • All information you provide is accurate and current

3. Service Description

HairSimulate provides AI-powered hair and eyebrow transplant simulation services that allow users to upload photos and generate simulated "before and after" visualizations showing potential restoration results. Authenticated members may also use optional Community features to share progress photos, stories, and linked simulations, and may optionally opt into the Clinic Marketplace to receive quotes and consultation offers from verified clinics.

3.1 Free Credits and Bonus Opportunities

  • Registered Users: Receive 1 free credit upon account registration
  • Phone-Verified Users: Receive +1 bonus credit upon phone verification (2 free credits total with signup)
  • Community First-Post Bonus: Eligible members may earn +1 bonus credit the first time they publish a qualifying Community post with a linked completed simulation, subject to current product rules
  • Credits are used to generate simulations (1 credit per simulation) and do not expire while your account remains active

3.2 Guest (Unregistered) Users

  • Limited to a free guest quota (1 free simulation per device/month, enforced via a pseudonymous device check with your agreement)
  • Guest simulations are lower resolution, watermarked, and subject to a 60-second processing queue delay
  • Only the browser session that created a guest result (verified via an HTTP-only ownership cookie) can claim and link that result to a registered account
  • Unclaimed guest simulation results are retained for up to 90 days after last activity

3.3 Authenticated Users

  • Access to high-quality HD simulations (1024px resolution) and optional Front-Fill or Clinical Timeline visualizations
  • All results include a subtle trademark watermark for brand protection
  • Immediate processing with no queue delay for phone-verified users
  • Ability to save, manage, and download simulations across devices
  • Access to simulation history and optional Clinic Marketplace settings
  • Access to Community features for sharing progress photos, stories, and linked simulations

3.4 Eyebrow Transplant Simulation

We offer an eyebrow transplant simulation mode that generates a mature restoration preview from a single front-facing photo. This feature may evolve in quality, availability, or parameters without notice.

  • Each eyebrow simulation consumes 1 credit, the same as a standard hair simulation
  • Results are illustrative only and are subject to the Medical Disclaimer in Section 3.5
  • You must upload a clear front-facing photo suitable for brow and facial analysis

3.5 Medical Disclaimer

IMPORTANT

The Service provides AI-generated simulations and community content for illustrative and informational purposes only. These simulations and community posts:

  • Are NOT medical advice, diagnosis, or treatment recommendations
  • Do NOT guarantee or promise actual hair or eyebrow transplant results
  • Should NOT be used to make medical or surgical decisions
  • Are NOT a substitute for an in-person consultation with a licensed physician or qualified surgeon

You acknowledge that actual surgical outcomes depend on donor capacity, scalp and skin characteristics, surgical technique, healing, and individual physiology, and may vary significantly from AI-generated simulations. Always consult with a licensed medical professional before making any decisions regarding hair or eyebrow restoration procedures.

4. User Accounts

4.1 Account Creation

To access member features, you must create an account by:

  • Providing accurate and complete information
  • Verifying your email address (via magic link or password confirmation)
  • Optionally verifying your mobile phone number via SMS one-time passcode (OTP) for bonus credits and anti-abuse protection

You may create an account or sign in using:

  • One-step email sign-in link (magic link / OTP)
  • Email and password
  • Google OAuth (including Google One Tap)
  • Facebook OAuth
  • Instagram OAuth

4.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials and email access
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access or security breach
  • Ensuring your account and contact information remains accurate and up to date

4.3 Account Suspension, Restrictions, or Termination

We reserve the right to restrict, shadow-ban, suspend, or terminate your account if you:

  • Violate these Terms or our Community Guidelines
  • Engage in fraudulent, abusive, deceptive, or illegal activity
  • Attempt to circumvent credit limits, guest device quotas, or security controls
  • Post prohibited content, spam, or unsubstantiated medical guarantees

5. User Content, Community, and Marketplace

5.1 User Content

"User Content" includes any photos, facial images, progress photos, hairline designs, simulation results, Community posts, comments, tags, bio text, reports, bookmarks, marketplace case notes, or other data you upload, submit, publish, or transmit through the Service.

5.2 Image and Community Upload Requirements

When uploading photos or posting Community content, you must ensure:

  • Simulation and Community image uploads use supported formats (JPEG, PNG, or WebP) and comply with size and resolution limits
  • Images clearly show your face and current hairline or brow area when required for simulation or face-blurring
  • You own or have the legal right to upload and share the images
  • You have obtained explicit consent from any identifiable individuals appearing in the photos
  • You do not post medical claims, guaranteed outcomes, or third-party personal data without authorization

5.3 Your Rights and License to HairSimulate

You retain all ownership rights to your original User Content. However, by using the Service, you grant us a worldwide, non-exclusive, royalty-free license to:

  • Store, process, reproduce, and display your User Content as necessary to provide and operate the Service
  • Generate AI simulations, enhancements, and de-identified (face-blurred) derivatives based on your User Content
  • Publish and display Community posts, comments, uploaded progress photos (with a hairsimulate.com watermark), tags, and attached simulation results according to your selected visibility setting (including Open Graph social preview cards for Public posts)
  • Share your selected case details, simulation results, and progress photos with verified clinics when you explicitly opt into the Clinic Marketplace
  • Moderate, scan, remove, restrict, or preserve Community content where necessary for safety, compliance, support, or enforcement
  • Store original and processed images securely for the retention periods specified in our Privacy Policy
  • Use anonymized, de-identified, or aggregated data for analytics, quality scoring, and service improvement

Important: We do NOT use your identifiable photos or facial images to train AI models without your separate, explicit consent.

5.4 Community Sharing and Moderation

Community is an optional social feature. Posts cannot be edited after publication (you may delete and recreate a post). If you publish a post, you choose to share the selected content under the visibility setting shown in the product:

  • Public: Visible to everyone, including logged-out visitors, search engines, and social media link previews (Open Graph / Twitter cards), and may be indexed, cached, screenshotted, or shared outside HairSimulate
  • Community: Visible to logged-in HairSimulate users
  • Anonymous: Hides your author display name and avatar from other users in the interface, but is not anonymous to HairSimulate; we retain the internal account association for ownership, deletion, support, safety, moderation, and legal compliance
  • Face De-Identification ("Blur my face"): You may enable automated face blurring (which obscures eyes and lower face while preserving the hairline). If face detection or blurring fails on an image while blur is enabled, publication of that unblurred image is blocked for your protection
  • Your Responsibility: You are solely responsible for what you share, including progress photos, simulation results, comments, tags, clinic or procedure details, and any personal or health information you disclose
  • Moderation and Enforcement: We use automated safety filters (nudity/NSFW scanning, toxicity and profanity filters, perceptual hash duplicate checks, and medical-guarantee keyword gates) alongside community reporting and human review. Posts reaching our report threshold may be automatically hidden pending moderator review, and we may remove, restrict, shadow-ban, or preserve content or accounts that violate these Terms

Community content is user-generated and is not medical advice. Do not use Community to harass others, impersonate anyone, disclose private information, post spam or unauthorized commercial promotions, make deceptive clinic or procedure claims, or guarantee medical outcomes.

5.5 Clinic Marketplace (Opt-In)

Authenticated users may optionally turn on "Open to clinic offers" in their dashboard Marketplace Settings to receive quotes and consultation proposals from partner clinics:

  • Explicit Opt-In: Marketplace participation is off by default. Turning it on creates an active case with the preferences you provide (goals note, budget range, and whether to share your saved simulations and/or progress photos)
  • Pause or Opt Out Anytime: Turning off Marketplace availability immediately pauses your case so no new clinic offers are solicited
  • Independent Clinics: Partner clinics are independent third parties, not employees, agents, or subcontractors of HairSimulate. HairSimulate does not endorse, perform, or warranty any medical procedure, quote, pricing, or consultation offered by a clinic
  • No Medical Liability: Any consultation, treatment agreement, or surgical procedure is strictly between you and the clinic. Always verify a clinic's medical licenses, surgeon credentials, and terms independently

5.6 Image Processing and Storage

Image Processing:

  • Uploaded images are validated, stripped of EXIF/GPS location metadata, and processed by our AI pipeline and third-party AI inference providers to generate simulations
  • Both original (before) and processed (after) images are stored in encrypted cloud object storage
  • Community progress photos are re-encoded, watermarked with hairsimulate.com, and stored in our Community storage bucket
  • Simulation results attached to Community posts are linked only after verifying account ownership

Image Storage and Retention:

  • Authenticated users: Simulation photos and results are retained while your account remains active, or until you delete them
  • Guest users: Unclaimed guest simulation photos and results are retained for up to 90 days after last activity (unless claimed into an account or deleted earlier upon request)
  • Community posts and images: Retained while the post and your account remain active
  • Deleted content and closed accounts: When you delete a simulation, Community post, or your account, it is immediately hidden from normal display and permanently purged from active storage within 30 days (unless subject to an active abuse investigation or legal hold)

Third-Party Processing:

  • Images are transmitted to third-party AI inference providers solely to generate your requested simulations and quality checks
  • AI inference providers are prohibited from using your identifiable images to train their models
  • All third-party processors are bound by data protection and confidentiality obligations

5.7 Optional Marketing Consent

Separate from the service license above, you may optionally grant us permission to use anonymized simulation images (with faces blurred or obscured) for HairSimulate's marketing and promotional materials. This consent is:

  • Completely optional and separate from using the Service
  • Requested separately and requires your explicit opt-in
  • Revocable at any time by contacting us or updating your settings
  • Limited to anonymized/obscured versions of your images
  • Not required to use the Service

If you revoke marketing consent, we will cease using the image in future promotional campaigns and delete the marketing record within 30 days.

5.8 Your Responsibilities

You represent and warrant that:

  • You own or have the legal right to use all User Content you submit
  • Your User Content does not violate any third-party rights (including privacy, publicity, or intellectual property rights)
  • You have obtained all necessary consents from any person appearing in photos you upload
  • Your User Content complies with all applicable laws
  • Your Community posts, comments, reports, and interactions are truthful and do not misuse another person's identity, private information, or medical context

5.9 Prohibited Content

You may not upload, post, or transmit User Content that:

  • Contains nudity, explicit sexual content, or adult material
  • Depicts violence, self-harm, hate speech, discrimination, or illegal activity
  • Harasses, threatens, bullies, doxxes, impersonates, or targets another person
  • Infringes on copyright, trademark, or other intellectual property rights
  • Includes non-consensual images, private personal data, or confidential medical information about another person
  • Provides unauthorized medical advice, deceptive clinic/treatment claims, or guaranteed medical outcomes (e.g., "100% guaranteed results")
  • Contains spam, undisclosed commercial promotion, clinic scams, malware, or harmful code
  • Contains images of minors (persons under 18 years of age)

6. Acceptable Use

You agree NOT to:

  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated systems (bots, scrapers, crawlers) to access or extract data from the Service
  • Attempt to bypass credit limits, guest device quotas, rate limits, queue delays, or quality restrictions
  • Misrepresent AI simulations as guaranteed medical outcomes or actual post-operative results
  • Use the Service for any unlawful, fraudulent, or harmful purpose
  • Interfere with or disrupt the Service, servers, or security controls
  • Impersonate any person, patient, doctor, or clinic, or falsely claim clinic verification
  • Scrape, harvest, copy, repost, or commercially exploit Community content or user profiles without authorization
  • Abuse the community reporting system (e.g., coordinated false reporting or brigading)
  • Use the Service to transmit spam, unsolicited promotions, or deceptive links

7. Intellectual Property and Feedback

The Service, including all software, algorithms, prompts, AI workflows, designs, text, graphics, trademarks, and logos, is owned by HairSimulate or its licensors and is protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use (or authorized clinic evaluation use) in accordance with these Terms.

If you submit feedback, suggestions, or feature ideas regarding the Service, you grant HairSimulate an unlimited, irrevocable, perpetual, royalty-free license to use and incorporate that feedback without compensation or attribution.

8. Credits, Payment, and Billing

Credits and Purchases:

  • Each standard hair or eyebrow simulation consumes 1 credit
  • Purchased credits and credit packages are processed through secure third-party payment processors
  • Credits are non-refundable once consumed on a completed simulation, except as required by mandatory consumer protection law
  • If a simulation fails due to a system error or is cancelled while still pending, the consumed credit is automatically refunded to your account balance
  • Promotional or bonus credits have no cash value, are non-transferable, and may be subject to anti-abuse verification

We reserve the right to modify credit pricing and package structures with reasonable prior notice. Price changes will not retroactively affect credits already purchased.

9. Service Availability and Modifications

We strive to maintain high Service availability, but we do not guarantee uninterrupted, timely, or error-free operation. We reserve the right to modify, suspend, or discontinue any feature or part of the Service (including beta features, Community, or Marketplace) at any time with or without notice.

10. Disclaimers of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

We do not warrant that AI-generated simulations will match actual surgical outcomes, that Community posts or clinic quotes are accurate or reliable, or that the Service will meet your medical or personal expectations.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HAIRSIMULATE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, GOODWILL, OR PROFITS, OR ANY MEDICAL OR SURGICAL OUTCOMES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR ANY INTERACTION WITH CLINICS OR COMMUNITY MEMBERS.

Our total aggregate liability for any claims arising from or related to these Terms or the Service shall not exceed the greater of: (a) the total amount you paid to HairSimulate in the 12 months preceding the claim, or (b) $100 USD. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless HairSimulate, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to your use of the Service, your User Content, your Community or Marketplace activity, or your violation of these Terms or third-party rights.

13. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, process, retain, and protect your personal, facial, and health-related data under GDPR, KVKK, and other applicable laws. Please review our Privacy Policy carefully.

Privacy Policy

14. Termination

You may stop using the Service and delete your account at any time through your account settings or by contacting us at info@hairsimulate.com. We may suspend or terminate your access immediately if you violate these Terms, engage in fraudulent or abusive activity, or create legal or safety risks.

Upon termination, your right to use the Service ceases immediately, and your account data and User Content will be scheduled for deletion within 30 days in accordance with our Privacy Policy. Sections 3.5, 5.3 (as to anonymized data and legal holds), 7, 10, 11, 12, 15, and 16 survive termination.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions. If you are a consumer residing in the European Economic Area (EEA), the United Kingdom, or Switzerland, this choice of law does not deprive you of the protection afforded by mandatory consumer protection provisions of the law of your country of habitual residence.

Before initiating formal legal proceedings, you agree to first contact us at info@hairsimulate.com to attempt to resolve any dispute informally for at least 30 days.

Subject to mandatory consumer jurisdiction rules under applicable law, any disputes that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts and enforcement offices of Istanbul, Turkey.

16. General Provisions

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HairSimulate regarding the Service. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.

We may update these Terms from time to time. Material changes will be notified via email, an in-app notice, and an updated "Last Updated" date. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
